Welcome to Typoedheart.com These terms and conditions outline the rules and regulations for the use and sale of artwork and services provided by Jori Hollander. By accessing this website we assume you accept these terms and conditions in full. Do not continue to use Typoedheart.com's website if you do not accept all of the terms and conditions stated on this page. The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, "The artist", "Myself", “I”, “My”, and "Mine", refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and myself, or either the Client or myself. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of my assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of United States. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Unless otherwise stated, Typoedheart.com and/or it’s licensors own the intellectual property rights for all material on Typoedheart.com. All intellectual property rights are reserved. You may view and/or print pages from http://www.typoedheart.com for your own personal use subject to restrictions set in these terms and conditions. You must not:

  • Republish material from http://www.typoedheart.com
  • Sell, rent or sub-license material from http://www.typoedheart.com
  • Reproduce, duplicate or copy material from http://www.typoedheart.com
  • Redistribute content from Typoedheart.com (unless content is specifically made for redistribution).


Reservation of Rights


I reserve the right at any time and in its sole discretion to request that you remove all links or any particular link to my Web site. You agree to immediately remove all links to my Web site upon such request. We also reserve the right to amend these terms and conditions and its linking policy at any time. By continuing to link to my Web site, you agree to be bound to and abide by these linking terms and conditions.


Rights and Licencing of Completed Work


I retain all rights to finished work. You may print, repost, and use any finished artwork for personal use only. All work republished online must contain a link back to the artist's website.


The client may, at their discretion, purchase a commercial licence for any completed work.


I retain all rights to print, publish, and distribute any completed works, unless otherwise negotiated.


Work Process and Schedule


My current work days are Monday, Wednesday, Thursday, and Friday and 'business days' refer to such. Upon finalizing the scope of the work, I will give you an expected day for the project to be completed.


Anything to be done in less than 30 days is subject to a rush fee, which will vary based on the details of the project.


For sketch commissions, I will send one in progress file, where any changes or adjustments can be finalized.


For any other work, I will send at least three concept sketches for approval before any other work begins. One cleaned sketch will be sent for final approvals and any changes before finishing the project. Upon completion, you have 14 days to request any final alterations. There may be a charge for any major changes not discussed in earlier drafts.


Pricing and Payment


Pricing listed on typoedheart.com, or other websites maintained by the artist, are only a guideline. Prices may vary based on the scope of the project, rush fees, complex characters, or other factors.


All payment is done through Paypal. 25% of the final price of all work is due up front and is considered a non-refundable deposit. Final payment is due within 7 days of sending the final watermarked files for approval. The final, full resolution, non-watermarked files will be sent upon receiving final payment.


Late payments are subject to a late fee of 5% of the final price per month after the agreed payment date.


Delivery of Goods and Services


All artwork is delivered as a high resolution digital file emailed to the client. At your request, I can issue a print release form if you would like to have your artwork printed. You are always free to print your finished artwork at home for personal use.


The default size for a finished work is 4 inches x 5 inches (1200 x 1500 pixels) at 300 DPI. Larger image sizes can be done for a negotiated price.


Refunds and Cancellations


Full refunds are available up until work has started on a project. After work has been started, any refunds will be prorated based on the amount of work done.



In the event I cannot finish a commission in the quoted time, you will be able to cancel the project for a full refund, including the deposit fee. No further work on the project will be done, and you will not receive any in-progress files if you choose to do so.


Retention of Images and Files


I will keep all files and final images associated with a project for one year after completion. You may request a replacement file for free any time within that year. After that time, I cannot guarantee that I will still have the full resolution file available.


I am not responsible for any outside force (hard drive crashes, cloud server errors, etc) that may result in lost files.


Content Liability


We shall have no responsibility or liability for any content appearing on your Web site. You agree to indemnify and defend us against all claims arising out of or based upon your Website. No link(s) may appear on any page on your Web site or within any context containing content or materials that may be interpreted as libelous, obscene or criminal, or which infringes, otherwise violates, or advocates the infringement or other violation of, any third party rights.


I retain no responsibility or liability for what the Client or third parties do with the artwork once the artwork is completed


Disclaimer


To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Nothing in this disclaimer will:


  • limit or exclude our or your liability for death or personal injury resulting from negligence;
  • limit or exclude our or your liability for fraud or fraudulent misrepresentation;
  • limit any of our or your liabilities in any way that is not permitted under applicable law; or
  • exclude any of our or your liabilities that may not be excluded under applicable law.


The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer or in relation to the subject matter of this disclaimer, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty. To the extent that the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.

Final Agreement


All articles of this Terms of Service Agreement are applicable unless specifically outlined within the final written agreement between Client and Artist.


Contacting the Artist is not a guarantee of accepted work.


By contacting me for work, you hereby agree to the terms expressed above.
